Employment and Labor Law
Downey Day provides preventive counseling and litigation representation to a variety of businesses with respect to employment and labor issues. Our clients range from small businesses to publicly traded international companies that include restaurants, lending institutions, medical corporations, non-profits, manufacturers, retailers, and many other businesses.

Preventive Counseling: Our attorneys offer advice and counseling to employers in an effort to avoid lawsuits and to enable businesses to operate productively. Our advice is prompt and responsive to the needs of clients. Specific areas of counseling include employee termination decisions, drug testing, and other personnel matters. We also review, prepare and update personnel policies and employee handbooks.

Litigation - Employment Discrimination and Wrongful Discharge: We represent our clients aggressively in employment-related lawsuits and administrative proceedings. We pride ourselves on our success in disposing of cases at the administrative level (DFEH or EEOC) and litigation through pre-trial dispositive motions and jury trial. We are also responsive to controlling litigation costs and expenses, in keeping with our firm’s philosophy of efficient representation.

Miscellaneous Employment and Labor Matters: We regularly represent clients in wage-hour disputes, hostile work environment, sexual harassment, age discrimination, workers’ compensation discrimination claims, employee benefit issues, and other employment-related matters.

Professional/D&O/Professional Fiduciary Defense
We handle the defense of a wide variety of professional liability insureds against errors & omissions claims, including corporate directors and officers, real estate and insurance agents and brokers, lawyers, appraisers, architects and engineers, financial institutions and other miscellaneous professionals. Professional liability claims are often susceptible to dispositive motions for summary judgment. We make these motions as efficiently and as early in litigation as possible to either dispose of the case or significantly narrow the issues for trial.

General Liability
Our experience in general liability/civil litigation covers a broad spectrum, ranging from complex automobile/motorcycle/trucking personal injury cases, premises liability cases to breach of contract, fraud and complex product liability litigation. We handle claims involving high exposure due to catastrophic injuries. Our lawyers have the experience to assess value and handle cases involving serious injuries and significant exposure from inception to trial.
